These Terms of Service (โ€œTermsโ€) govern your access to and use of the services provided by Premier Merchant Services, including but not limited to credit card processing, installation and support of POS systems, and delivery of customized payment solutions. By accessing our website or signing up for any of our merchant services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, please do not use our services.

Scope of Services

Premier Merchant Services provides a wide range of financial technology and merchant support services to businesses across the United States. Our offerings include:

  • Credit and debit card transaction processing

  • Point-of-sale (POS) systems and equipment setup

  • Online and mobile payment gateway integration

  • Merchant account setup and consultation

  • Technical support and ongoing service management

These services are intended for commercial business use only. We do not provide services to individual consumers or for personal use.

Eligibility and Registration

To access and use our services, you must:

  • Be at least 18 years old

  • Own or represent a registered business operating in the United States

  • Provide complete and accurate business and identification information

  • Agree to all terms, fees, and conditions outlined in this agreement

You are responsible for keeping your account login credentials confidential and for any activity conducted under your account.

Service Availability

We aim to provide reliable and continuous access to our services. However, service availability may occasionally be interrupted due to maintenance, system upgrades, or circumstances beyond our control. Premier Merchant Services does not guarantee uninterrupted service access.

We reserve the right to:

    • Modify, suspend, or discontinue services at any time without notice

    • Terminate or restrict accounts that violate these Terms

    • Deny service to businesses that do not meet compliance or risk standards

Merchant Responsibilities

By using our services, you agree to:

  • Operate in compliance with all local, state, federal, and industry regulations

  • Keep your business, banking, and contact information accurate and up to date

  • Maintain PCI compliance and data protection protocols when handling cardholder data

  • Promptly notify us of any unauthorized or suspicious activity on your account

  • Comply with all contractual terms, including equipment handling and usage limits

Failure to comply may result in service suspension, financial liability, or permanent termination of services.

Payment Terms and Fees

Service fees may be billed on a recurring basis (monthly or annually) or per transaction, depending on your agreement. Charges may include:

  • Transaction processing fees

  • POS hardware or software license fees

  • Monthly service, maintenance, or gateway access fees

  • Replacement or upgrade costs for equipment

  • Early termination or cancellation penalties, if applicable

You are responsible for maintaining sufficient funds in your linked account to cover all charges. Late payments may result in interest or penalty fees as specified in your contract.

Termination of Services

You may cancel your account at any time by contacting our support team, subject to early termination terms outlined in your agreement. Premier Merchant Services may suspend or terminate your account under the following conditions:

  • Breach of any part of these Terms

  • Prolonged account inactivity

  • Suspected fraud, abuse, or unlawful activity

Termination does not release you from any outstanding payment obligations or return of leased or loaned equipment.
